The charges were linked to a defendant found in possession of arms at the school zone. The respondent was then convicted for the jury trial the court of appeal. Furthermore, the respondent was convicted for violating the Gun-Free School Zones Act of 1990 (GFTZA)

The situation occurred when the respondent was in the 12th grade. He arrived at one of the high school in San Antonia carrying a concealed gun. He was then arrested with the possession of the firearm at the school premises. Consequently, the federal agencies took part in the judgment of violating the Gun-Free School Zones Act (GFSZA) of 1990.
Issues
Under the Texas law, firearm possession is considered as a violation especially around the school facilities. The respondent got convicted of this violation. However, he went ahead to argue that it is beyond the power of Congress to adopt legislative control over public schools. The district court denied this while considering that the process is part of the constitutional exercise that requires them to regulate activities affecting the commerce. As a result, he waived the case to the jury trial since the district court found him guilty of violating the state laws. The court outlined its constitutional powers which applied through the federal government of enumerated powers. Therefore, the powers are delegated to the chief justice to deliver the opinions of the court.
