1 Synopsis
The case which requires mitigation is between Mary Booth and Bob Simonsky. The complainant is Booth, who accuses Simonsky of sexual harassment. Simonsky works as a forklift driver in SenGlas. Inc. warehouse, whereas Booth is the shipping coordinator. Simonsky believes that women should work in a warehouse, and it is for this reason that he devotes himself to make it hard for Booth to work. Correspondingly, Booth has reported the case to the supervisor, but there is nothing that he did. It is for this reason that she has reported the case to James Tilden, the Human Resource Manager at SenGlas. Inc. In particular, she accuses Simonsky of false accusations, which renders her to have a negative relationship with other employees such as Ginny Miller. Other accusations including frightening Booth by driving the forklift towards her, slamming the metal forks in her presence with the objective of intimidating her, refusal to take directions from the shipping coordinator, and Simonsky throwing cigar rete butts at her. Accordingly, it is appropriate to evaluate the company's policy to determine whether Booth's accusations are relevant and to decipher the way forward in resolving the conflict.
2 Dilemmas

The major bone of contention is whether the actions of Simonsky towards Booth qualify as sexual harassment. The fact that Simonsky makes it hard for Booth to work in the warehouse because she is a female indicates that he is engaging in sexual harassment. According to the SenGlas Inc. policy, “We recognize sexual harassment as unlawful discrimination, similarly to conduct that belittles or demeans any individual on the basis of race, religion, national origin, sexual preference, age, disability or other similar characteristics or circumstances” (U.S. Department of the Interior, 2021). Based on the allegations of Booth, his harasser, Simonsky has been treating him unfairly and showing nasty behaviors because he does not like working with women and that women do not belong in the warehouse unit where he is stationed. Simonsky had on several times showed temperament such as throwing cigarette butts toward Booth, intentionally revving forklift driven straight toward Booth to hurt her physically. These are proofs of a man's conduct that implies belittling and demeaning of the capacity of an employee or a co-employee just because she is a woman.
Nevertheless, it is also possible for Simonsky to persuade the human resource manager that he did not engage in sexual harassment. It is possible for Simonsky to argue that he did not do anything inappropriate but only to issue empty threats. In light of the organization's current approach to inappropriate behavior, there is the possibility of the forklift driver to assert that he does not accept that Mary Booth's case fulfills the meaning of inappropriate behavior. Notwithstanding, Simonsky may accept that her case would be more appropriate for an ordinary badgering case.
