Hot Wheel City Will Pay $20,000 to Resolve EEOC Sexual Harassment and Retaliation Lawsuit
DETROIT -- Hot Wheel City, a Detroit-based automotive wheel and accessory store chain, has agreed to pay $20,000 and to provide equitable relief to settle a federal sexual harassment and retaliation lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.
According to the EEOC's suit, Hot Wheel City subjected a female employee to a sexually hostile work environment at the hands of a male co-worker. The EEOC also charged that the employee reported the sexual harassment and was thereafter fired in retaliation for complaining.
Such alleged conduct violates Title VII of the Civil Rights Act of 1964. After first attempting to reach a pre-litigation settlement through its conciliation process, the EEOC sued Hot Wheel City (EEOC v. Hot Wheel City, Inc., Case No. 2:14-cv-11287) in U.S. District Court for the Eastern District of Michigan.
In addition to providing monetary relief to the employee, the seven-year consent decree settling the case requires Hot Wheel City to institute new anti-discrimination policies and procedures; conduct training twice a year on sexual harassment and retaliation; provide reports to the EEOC regarding its training; and permit the EEOC to monitor its compliance with the terms of the consent decree.
"Hot Wheel City has committed to making significant changes that should be beneficial to current and future employees as well as the company," said EEOC attorney Nedra Campbell. "The company should be commended for resolving this case at this juncture-well before trial."
Hot Wheel City provides wheels, rims and accessories through its six retail locations located in the Detroit metro area and in Toledo, Ohio. The company has been in business since 1995.

According to a complain received by Equal Employment Opportunity Commission (EEOC), a female employee was sexually harassed by her colleague at Hot Wheel City. The female employee was then sacked after she had reported the act, which was viewed as retaliation. Hot Wheel City violated the civil right Act of 1964 under title VII. The civil right Act of 1964 under the title VII forbids employment discrimination based on race, color, religion sex and nationality (Wright, 2005). This Act permitted the establishment of Equal Employment Opportunity Commission to enforce the Title VII by conducting investigations, mediating and if possible file lawsuits on behalf of employees. According to the Act individuals affected are required to file complaints related to discrimination with the EEOC within 180 days .The law applies only to employers with more than 15 workers engaged for 20 or more weeks (Wright, 2005).
The Detroit-based automotive Hot Wheel City incurred losses through compensation. The employee affected was awarded $ 20,000 inclusive of back pay, compensatory damages for emotional distress. Hot Wheel City status is at risk because in public view, because the lawsuit brought them to the limelight as human rights violators. This might affect future potential growth and. The Equal Employment Opportunity Commission’s (EEOC) main role is to implement Federal laws to protect employees against discrimination based on race, color, religion, sex, pregnancy, and nationality. The authority has the power to investigate, assess the allegations and make appropriate findings. If any discrimination is noted, the authority tries to settle the charges outside the courtroom. If consultations are not successful, then the authority files for a lawsuit on behalf of the employee in order to protect individual rights and the public in general. In the case of Hot Wheel City, a lawsuit was filed after the reconciliation process failed. In relation to the lawsuit filed by EEOC on behalf of an employee of Hot Wheel City, the commission role included receiving the complain and trying to mediate between the two parties. In this case, mediation failed prompting the commission to file a lawsuit on behalf of the complainant. Eventually the District Court of Michigan provided the employee with financial relief and Hot Wheel City was further directed to establish new procedures and policies against discrimination. The company was also directed to organize training on sexual harassment and retaliation for its employees twice a year as EEOC was to monitor compliance (EEOC Press Releases, 2015).
