The American citizens have the freedom to speech, assembly, press and assembly. The first amendment protects this right. The first amendment was only applicable to the federal government. However, changes were made, and the law became applicable to all the states. The freedom to speech is limited when a situation presents a clear and present danger to the public. Among the elements that show a clear and present dangerous situation is where the speech or action includes a threat resulting in harm. If the threat is real, this qualifies the situation to be classified as clear and present danger (Greenawalt, 2018). An example is a case of using guns in rioting and the speech used during such riots. If the actions or speech can cause harm to the public, then the freedom to speech is not applicable.
