Countries have different systems when it comes to court proceedings and imprisonment. What is practised in one country will differ from what happens in another country. Hence, it is critical to examine the criminal justice system of a country in order to analyze its strengths and weaknesses. The major focus of this analysis will be the court proceedings and imprisonment in France. The case involves a young lad aged 15 years who engaged in robbery in France.
Court’s view of the accused rights
The court will start by asking the accused a few questions like his identify, record etc. The court will then summarize the charges brought against the accused. The step is critical to assist the accused to understand the charges before the court. The court will then proceed to question the young man on the facts. The accused can choose to remain silent. Witnesses to the robbery will be called and examined. The victim’s lawyer will begin by indicating the role of the young man in criminal proceedings. Next, the public prosecutor will proceed to argue the case. Lastly, the defense lawyer will proceed to defend the accused against all the accusations brought against him. Then, the court will ask the accused if he has anything to add to what the defense lawyer has said. During the entire process, the accused will be treated as innocent until the court declares him guilty (Quintard-Morénas, 2010). Additionally, the accused has a right to appeal against the sentence and conviction if he is not happy with it.
The experience of the defendant in prison
If the accused is sentenced to death, then he will experience a difficult time in prison. Due to the unavailability of basic facilities for the prisoners, the level of competition for resources among the inmates is high (Crétenot & Liaras, 2013). Given that the accused is 15 years, he could be misused by the much older prisoners. Furthermore, the accused will be separated from his family. He will be unable to see his family members for a long time. This could have an adverse effect on the psychological growth of the young man. Additionally, the accused will have no access to technology. At the age of 15 years, the accused would like to engage with technology. However, the prisoner will be unable to enjoy this privilege. He will be forced to stay without technology for the time that he will be imprisoned.
Ethical concerns regarding French’s court and correctional systems.
The court system of France takes a long time to make a decision. Handing down a sentence is normally a slow process that could take weeks and even months after the hearing (Desrieux & Espinosa, 2019)...
