Employment At-Will Doctrine

Essay Instructions:

Imagine you are a recently-hired Chief Operating Officer (COO) in a midsize company preparing for an Initial Public Offering (IPO). You quickly discover multiple personnel problems that require your immediate attention.
John posted a rant on his Facebook page in which he criticized the company’s most important customer.
Ellen started a blog to protest the CEO’s bonus, noting that no one below director has gotten a raise in two (2) years and portraying her bosses as “know-nothings” and “out-of-touch”
Bill has been using his company-issued BlackBerry to run his own business on the side.
After being disciplined for criticizing a customer in an email (sent from his personal email account on a company computer), Joe threatens to sue the company for invasion of privacy.
One of the department supervisors requests your approval to fire his secretary for insubordination. Since the secretary has always received glowing reviews, you call her into your office and determine that she has refused to prepare false expense reports for her boss.
Anna’s boss refused to sign her leave request for jury duty and now wants to fire her for being absent without permission.
As an astute manager, you will need to analyze the employment-at-will doctrine and determine what, if any, exceptions and liabilities exist before taking any action. As you proceed with your investigation, you discover the company has no whistleblower policy.
In preparation for this assignment, use the Internet or Strayer Library to research your state’s employment-at-will policy.

The primary action(s) that you should take to limit liability and impact on operations; specify the ethical theory that best supports your decision.

Introduction
Employment in the United States has been a major way in which individuals earn a living. It is also through this that individuals have been capable of improving their living standards via the amount of income that they receive from their employers. Moreover, in the employment industry, there also exist trade unions and other organizations whose sole mandate is to ensure that there is collective bargaining for the employees. On the other hand, the employment-at-will doctrine has nothing to do with protection of en employee. Additionally, it assumes that employment should be for unspecified period of time, unequal bargaining between the employer and his employee and can be terminated by both parties at any period of time. In this paper, analysis on the doctrines and more on the policies of employment including the actions to be taken in the various scenarios will be highlighted.
In summary of the text, to begin with John’s actions of criticizing the company’s customer was very wrong. This is because, the customer may feel intimidated and hence he may not seek the services of the company anymore. This may also extend to other customers hence it can be a big drawback to the company. On the other hand, Ellen’s action to start a blog is justified but it is wrong on the way she criticizes her bosses as know-nothings and out-of-touch. It is very uncouth to use such language in describing the top managers and bosses of the company. However it could be rational for her to air her grievances in a more professional and respective manner. Bill on the other hand has been using the company resources to aid his business operations. This is also wrong of him since the company goals should take precedence of personal goals (Sappideen, 2011). The gadget was specifically meant to run the operations of the company, thus using it for his own purposes may bring in some inconveniences to the company.
It is the mandate of the company to take action to employees like Joe, whose email was used in criticizing a customer. It is also his right to take action against the company if he feels that the company has infringed on his privacy (Jansen, 2010. The discipline from the company is to ensure that such cases are minimal and not recurrent as they may tarnish the name of the company in the eyes of its customers. In Anna’s case, it wrong for her for staying absent at without permission from her boss. On the other hand the boss is also not justified to deny her permission for her leave request without explaining on the clear reasons why it is not possible for her to go for leave. The supervisors request for me to fire his secretary because she has failed to cooperate with him in preparing false expense is ill-mannered. This is because, he can terminate the secretary’s job in the company and also his intensions to steal ...
