The establishment of the immigration reform and control act (IRCA) in 1986 was to ensure only the legal migrants (with proper documentation), and the US citizen got employment. According to this law, the employers are the primary identifying factors of the immigrants. Therefore, the law created provisions and responsibilities for the employers.
According to ICRA, it is the responsibility of the employers to keep records of the employees (Novick & Leiden, 1986). Besides, they should verify all new employees based on the provisions of ICRA. In this, they should identify if the employees possess work authorization and the works identity. Furthermore, this provides for the type of documents approved for use during the hire to demonstrate eligibility and identity (Novick & Leiden, 1986).
Besides, ICRA provides penalties to all employers who knowingly recruit, hire or refer employees for a fee for employment. According to ICRA, this constitutes a criminal offence, and such employees should be punished in accordance with this law (Martin, 2003).
