The United States constitution provides for division of power in the three main branches of power: the Executive, Legislative, and Judicial that spells the laws to monitor the powers of other branches to curb abuse of power. The Legislative writes, enacts laws and taxes, authorizes borrowing, and prepares the budget. It has authority to declare war and commence investigations against the executive branches. The Senate considers presidential appointments of judges and executive department heads, approves treaties in the RepresentativesHouse and mayremove, judicial and executive officers. Besides, forms federal courts apart from the Supreme Court (Llers, 2013).
The Executive may stop or order the start of war at the direction of Congress, appoints executive department heads and judges can pardon convicted persons, and declare the state of emergency.The Judicially determines laws Congress intend to apply in specific cases, determines if a law is constitutional or unconstitutional, determines how a law is used to determine disposition of prisoners and determining how congress applies law to solve disputes. Moreover, to determine the interpretation of laws to determine consistency in case rulings and appeal processes (Boston, 2007).
The US president has powers to check over Congress by exercising his power to forbid bills, but Congress can cancel any veto by a vote oftwo-thirds majority in both houses. When both houses of Congress fail to come into consensus on the adjournment date, the president can settle the dispute by calling both houses to attend an emergency session.The president being the commander of the US Army has the authority to order the armed forces to take the necessary military action in case of emergency of sudden crisis.
