Question 1
The case involves a 51-year-old man who accused the hospital for perpetrating a medical malpractice that lead to his brain damage. The man was undergoing surgery when he developed complications that required resuscitation. When the surgeon ordered 150 mg of amiodarone, which is a medicine used for normalization of abnormal heartbeats, the anaesthesiologists administered three vials of what 900 mg each (Capazzola, 2016). He believed that what he was delivering was 50 mg of amiodarone vials. After administering the medication, the patient stabilized, and the surgery completed successfully. However, some complications developed after the surgery, leading a permanent damage of the patient’s brain. The man was unable to function on his own and required medical care for the rest of his life (Capazzola, 2016).

In the suit filed, the hospital denied liability but admitted the communication breakdown (Capazzola, 2016). In a trial that spanned for two weeks, the man was awarded $12.2 million, which included $6.4 million to cover medical costs and $5.8 for the pain and suffering. Based on the decision of the jury, the anesthesiologist was found to be 25% responsible, the hospital 60% responsible, and the healthcare provider for whom the anesthesiologist worked for was found to be 15% responsible (Capazzola, 2016).

When an individual is injured while receiving medical care, he or she is warranted to file a suit with an attorney who will force the medical malpractice claims. In addition to the surgeon and other healthcare practitioners in the medical care hierarchy, hospitals can also be sued for some instances of malpractice. The lawsuit may be based on the fact that the healthcare institution acted negligently. In this case, it is usually believed that they did something unreasonable or failed to take specific precautions that led to the patient’s harm, damage, or death. Some of the sources of negligence that a hospital can be accused of including not ensuring that the workers have adequate education, training, or license to undertake specific clinical processes.
The hospital may also be given liability when it fails to undertake a thorough proofing of the background of its personnel or those who are not direct employees of the hospital, such as surgeons and physicians who administer care to the patients. Since the hospital is direct employers of the practitioners, the hospital shares an employer/employee relationship and can be sued under the doctrine of respondeat superior (When Can the Hospital Be Sued for Malpractice, n.d.).
