Defendants’ competency is determined by the forensic psychologists who thoroughly examine their mental state. After investigating, they inform the courts of the sanity or ability to make decisions by the defender (Bartol, C, & Bartol, A., 2017). They carry out assessments by a series of questions with the help of psychiatrists who attended to the suspects before. They testify of their current state of mind. Defendants who are mentally unstable do not have the mandate to represent themselves. The judge mostly suspends their criminal cases until they recover. A defendant who does not understand the proceedings during their trial is deemed unfit to continue with the trial. Issues of mental health disability like the diagnosis from schizophrenia are mandatory if the courts suspect the offender. Mostly, it is undertaken for first degree crimes like murder, suicide, attempted murder, or robbery with extreme violence.
The results of the assessment should inform the next decisions of the cour, whether the defendants can adequately represent themselves or not. Mostly, the judicial system approved of equity, where each side of an ongoing case has a qualified representative. This can either be a hired legal practitioner or the individuals in the case. Mostly, cases where there is high level of competency, require the services of a competent individual for an effective judicial process. If a judiciary terminates an ongoing case pending the determination of skill, they should be able to assess proper results after the individual recovers. That will give the go-ahead to resume and adequate judgment made. Rushing the process with the competency of the individual confirmed leads to misrepresentation of facts and weak arguments in the case. It is noteworthy to mention that both parties should understand the importance of mental assessments when doing through a judicial procedure, to enhance the transparent service of justice. It is common to practise that the defendant can be held in a recovery facility, paid by either the government or judicial department, to allow their recovery.
