Scenario
In Project Two: Assessing Financial Performance, your loyalty rewards program product line proposed a marketing and sales campaign targeting low-income neighborhoods. While you were doing your KPI analysis, the company’s legal team reviewed the same document to address any legal or ethical concerns.
The company CEO has forwarded you a memo from the legal team that discusses legal and ethical issues. Changes in the plan must be made to address these issues. Without these changes, the legal team will not approve the marketing and sales proposal.
For each issue, the CEO wants you to recommend changes to the proposal that satisfy the requirements the legal team has described. For the legal issues, the company lawyers describe how the company needs to interpret and apply existing laws.
Directions
Your task is to evaluate the memo from the legal department for legal and ethical concerns and recommend ways to address those concerns in alignment with organizational parameters.

For each legal issue, include the requirements outlined below:

Recommend changes to address the legal concerns.
Cite or quote their language to show what you are addressing.
State what aspects of the plan need to change in some way to address the concern.
Recommend one or more possible changes.
Explain how your recommendations meet the legal requirements.

Using the Project Three Response Memo Template, create one double-spaced memo of 3 to 6 pages. This memo should address the legal requirements and ethical issues. Check your memo for correct spelling and grammar, and include references cited in APA format. Consult the Shapiro Library APA Style Guide for more information on citations.

The company's sales and marketing team is looking for the best way to boost its profits while taking care of the low-income markets, both legal requirements and ethical concerns face it. The legal requirements are two, which include the truth in advertising and data collection and privacy. On the other hand, it has three ethical concerns: direct marketing to low-income populations, transparency in its language, and consumer data collection and use. Since the organization cannot solve these legal requirements and ethical issues through the current performance, the paper will analyze the recommendations to help the organization perform optimally.
Addressing the Two Legal Requirements
Truth in advertising: Analysis and recommendations
One of the areas that the organization has to improve is embracing truth in advertising. In most instances, organizations have been tempted to give false advertising. The main reason has been when they give false information; they always attract more clients. To ensure that it maintains truth in advertising, the company should follow the guidelines set by the Federal Trade Commission. For instance, the business should ensure that it prevent giving any false information through advertising which could help to boost its sales.
One way it could achieve this is by backing the information it shares with scientific evidence. Previously most businesses have been giving false information since they have depended merely on opinions. Since the opinions cannot be proven and can differ from one person to another, businesses have been using them to advance their selfish agenda. However, using scientific evidence will help the company to control this problem. For example, using scientific evidence in advertising will help the company maintain the truth since the information will depend on facts that can be proven or negated. For instance, when giving statements regarding the program's benefits, the organization should embrace the culture of backing this information with relevant scientific evidence. This process helps maintain the company's image since it could have maintained integrity.
Furthermore, the business is protected by the First Amendment Law; it should ensure that there are limits to this freedom. For instance, the organization should ensure that the speech that it is giving is not deceptive. The main reason is if the information is misleading, it could expose the customers to some risks. Furthermore, the advertisers should control their superiority claims. For example, if the business implies that it is superior to its competitors, it would likely influence the final decision.
