Legal Rights and Responsibilities of Tenants and Landlord
The tenancy agreement and any other laws related to landlord and tenancy resides in both the state laws and the federal legislation, which addressees the governance and location of property. The properties that are guarded or subjected to this law include; mobile home, apartment; houses, stores, or continuum that falls within the federal and state laws governed jurisdictions and incorporated in the rental contracts (Strauss, 2013). Thus, rights and responsibility of both the landlord and the tenant are captured in the tenancy agreement to provide procedure of solving and avoiding tenancy problems.
To begin with, as tenant, Roger’s responsibilities include; a duty to pay rent timely as agreed, which can be paid on weekly, monthly or other agreed times basis (Merrill & Smith, 2010). In addition, tenants are obliged to pay security deposit and other charges such as garbage collection, sewage utility cost, electricity, water bills prior moving into the property (Merrill & Smith, 2010). Also, a tenant has a duty to keep the rented unit clean and free from damages, not to use the property for anything illegal and moved out in accordance with agreed terms in the tenancy (Merrill & Smith, 2010).
On the other hand, the tenants have the rights, which tend to vary in different states. These rights include, the entitlement to a private and peaceful lifestyle; free from disturbances and harassment from other tenants and the owner (Merrill & Smith, 2010). Also, tenants have the right to have the rentals repaired and renovated at a convenient period, with exceptions to the need of prior notice only (Merrill & Smith, 2010). Relatedly, tenants are expected to update the landlord of all the information on repairs that needs to be attended to in time. Furthermore, the tenants have the right to vacate from the premises, with at least, seven days, one month notice depending on the state or federal provisions (Vliet, 2015). Tenants have a right to receive fully disclosure from the landlord, who has to disclose negative information about the property if any, this is connected to the tenants right to reside in a habitable premises; a habitable home is the one that has no unsafe conditions such as roof leakages, wall cracks, stained ceiling, poor lighting, holes on the floors as well as gross infestation of vermin such as bedbugs, mice and cockroaches (Vliet, 2015).
As a Landlord, Larry’s rights include; right to collect rent payments in the agreed periods, right to maintain ownership of the property after the termination of the tenancy term. Also, the landlord has the right to receive complains and updates regarding the conditions of the properties (Strauss, 2013). Also, as landlords, their obligations include, a duty to refund the security deposit at the termination of the tenancy agreement. In such a situation, the tenant is refunded whole of the deposit if the property is surrendered in the same conditions as it was rented (Strauss, 2013).
